Wisconsin real estate practitioners joined REALTORs® from across America in May to lobby Capitol Hill on several bills, including H.R. 5419 – The Direct Seller and Real Estate Agent Harmonization Act. Originally introduced by US Rep. Tim Walberg (R-MI) with Tony Cárdenas (D-CA), Blake Moore (R-UT), and Henry Cuellar (D-TX), this bill will amend the Fair Labor Standards Act (FLSA) to protect direct sellers and real estate agents. While the ability to work as an independent contractor has been recognized under the Internal Revenue Code (IRC) since 1982, recent lawsuits and new federal rulemaking to address other industries have put this protection in doubt.
