The Wisconsin REALTORS® Association (WRA) wrapped up a strong legislative session, and the wins go well beyond residential. For CARW members, several of these victories have direct implications for commercial real estate deals, development, and property ownership across the state.
Here’s what stood out:
- Historic Rehabilitation Tax Credit (Act 238) — This one’s a direct win for commercial. It’s now easier to restore and reinvest in older commercial and residential buildings, supporting downtown revitalization and adaptive reuse projects.
- Residential TIDs (Act 235) — Communities can now create residential tax incremental districts to fund infrastructure for housing development. More housing supply means more demand for commercial services, retail, and mixed-use development.
- “Truth in Planning” (Act 237) — Requires local zoning to align with comprehensive plans, reducing development delays and increasing predictability — a major win for anyone moving projects through municipal approval processes.
- Plat Review Reform (Act 173) — Streamlines subdivision approvals with clearer timelines and pre-submission reviews, cutting delays that affect commercial and mixed-use development.
- Protecting Property Owners (Act 32) — Prevents unfair burdens from recorded contracts that don’t improve or develop property — an important protection for commercial property owners.
- Taxpayer Protection Amendment (SJR 116) — A proposed constitutional amendment heading to the November 2026 ballot that would prevent the governor from using partial veto power to create or raise taxes — a safeguard for property taxpayers statewide.
- Enhanced Real Estate Practice Transparency (Act 69) — Bolsters consumer transparency and eliminates firm-to-firm compensation, positioning Wisconsin as a national leader in real estate standards. Effective January 1, 2027.
